Is there an AML/CFT regime?

Yes — We have Anti-Money Laundering laws (AML) and Proceeds of Crime and Combating the Financing of Terrorism laws (CFT). All licensed financial institutions are required to comply with this regulation. Afghanistan passed new AML and CFT laws in June 2014. Both the AML and the CFT incorporate provisions regarding compliance with international standards set forth by the Financial Action Task Force (FATF) address the criminalization of money laundering and the financing of terrorism, the requirement of customer due diligence, the establishment of a Financial Intelligence Unit (FIU), international cooperation, extradition, and the freezing and confiscation of funds. The AML law also includes provisions to address cross-border currency reporting and authorizes authorities to seize and confiscate undeclared or falsely declared money or money that has been transferred for illicit purposes. However, the capability to enforce these provisions is nearly non-existent and the provisions are largely unknown in many parts of the country. Pending
